Tonal SMS/Text Messaging Terms and Conditions

Tonal Systems, Inc. ("Tonal," "we," "us," or "our") offers a text messaging program (the "Program") that allows us to send you information about your Tonal membership, products, services, promotions, and other updates via SMS and MMS messages. By opting in to the Program, you agree to these SMS/Text Messaging Terms and Conditions ("SMS Terms").
1. Program Description
The Program may include, but is not limited to, the following types of messages:
Order and shipping updates
- Membership and subscription reminders
- Promotional offers, discounts, and product announcements
- Workout tips, challenges, and content recommendations
- Customer service communications
- Surveys and feedback requests
2. Consent and Opt-In
By providing your mobile phone number and agreeing to receive text messages from Tonal, you consent to receive recurring automated marketing and informational text messages at the mobile number you provide. Consent is not a condition of any purchase. You do not need to opt in to the Program to purchase or use any Tonal product or service.
3. Message Frequency
Message frequency varies depending on your account activity and the types of messages you have opted in to receive. You may receive up to 10 messages per month, though frequency may increase during promotional periods or based on your interactions with Tonal.
4. Message and Data Rates
Standard message and data rates may apply to messages sent or received in connection with the Program, depending on your mobile carrier and plan. Tonal is not responsible for any charges your carrier may impose.
5. Opt-Out
You may opt out of the Program at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a single confirmation message to confirm that you have been unsubscribed. You will no longer receive text messages from the Program unless you re-subscribe. You may also opt out by contacting us by emailing support@tonal.com or calling (855) 698-6625. We will process your opt-out request within 10 business days. Opting out of the Program will not affect any other communications you receive from Tonal (such as email), unless you separately opt out of those as well.

7. Supported Carriers
The Program is supported on major U.S. wireless carriers, including but not limited to AT&T, T- Mobile, Verizon, and U.S. Cellular. Tonal does not guarantee message delivery. Carriers are not liable for delayed or undelivered messages.
8. No Warranty
The Program is provided on an "as-is" basis. Tonal makes no warranties, express or implied, regarding the availability, timeliness, or accuracy of messages delivered through the Program. We reserve the right to modify, suspend, or discontinue the Program at any time without notice.
9. Privacy
Your information will be collected, used, and shared in accordance with our Privacy Policy. We will not sell, rent, or share your mobile phone number or any information collected through the Program with third parties for their own marketing purposes without your consent.
10. Eligibility
The Program is available to residents of the United States who are 18 years of age or older and who are the account holder or authorized user of the mobile device associated with the phone number provided.
11. Changes to These Terms
We may update these SMS Terms from time to time. If we make material changes, we will notify you by posting the updated terms on our website. Your continued participation in the Program after any changes constitutes your acceptance of the revised terms.
